Health Canada announced on December 23, 2021 that the coming into force of the Patented Medicines Regulations has been delayed for another 6 months to July 1, 2022. As a result, implementation of the New PMPRB Guidelines (which in part rely on the amended Regulations) are also delayed until July 2022. Further information can be found on the Health Canada website.
Given recent court decisions, there is some doubt as to whether the New Guidelines can be implemented without significant changes and further consultations. PDCI is hosting a webinar January 25 (see below) that will provide an overview of the impact and implications of the delayed Regulations and Guidelines.
Form-2 Filing Reminder
PMPRB Form 2 filings are due January 30, 2022. As the current Regulations remain in force, the January filing requirements will be as per the current Regulations and Guidelines, including reporting sales data by class of customer and province, and filing Block 5 information based on the PMPRB7 reference basket.
